Terms of Service for the Rinelle Application

Last updated: October 6, 2026

Effective: October 20, 2026

Notice: This document was originally drafted and published in the Polish language. Versions in other languages (including this English version) are provided strictly for convenience and informational purposes. In the event of any conflict or ambiguity between versions, the Polish text shall govern and prevail. Read the official Polish version here.

These Terms of Service (the "Terms") govern the use of the Rinelle application on the Discord platform, its associated commands, user interface, and available features (hereinafter referred to as the "Application", "Bot", or "Service").

Please read this document carefully before adding Rinelle to your Discord server or using its features on other servers. By using the Application, adding it to a server, or purchasing optional digital upgrades, you acknowledge and agree to be bound by these Terms and the associated Privacy Policy.

1. General Information and Contact

The Application is developed and maintained as an independent personal hobby project by an individual:

  • Project Creator: amatsagu (Discord ID: 390394829789593601, Rinelle Project)
  • Project Bot User: Rinelle (Discord ID: 1545008462126252122, Rinelle#5024)
  • Project Location: Poland, European Union
  • Contact and Inquiries: [email protected]

Rinelle is an independent, non-commercial project developed and maintained in the Creator's spare time. Reasonable efforts are made to ensure that the Application operates securely and stably, and that its features and documentation remain up to date.

Any technical bugs, security vulnerabilities, ambiguities in these Terms, or operational issues should be reported via the Official Support Server on Discord or directly to the contact email address. Every inquiry is addressed individually, with reasonable efforts made to resolve reported issues promptly.

2. Definitions

  • Creator - amatsagu, the author, developer, and sole administrator of the Application.
  • Application ("Bot" or "Service") - the Rinelle software operating within the Discord platform, encompassing its commands, interface components, and related services.
  • User - any individual who accesses or interacts with the Application, executes its commands, or interacts with its menus.
  • Server (or "Guild") - a server within the Discord platform where the Application is installed or where its features are executed.
  • Color Roles - cosmetic roles on a Discord server assigned and configured via the Server's color palette or Application menu. Roles are bound to a specific Server and cannot be transferred across servers; however, exporting their configuration scheme for replication on another Server is permitted.
  • Community Badges - virtual badges and distinctions created, granted, or displayed on a User's profile through the Application. Badges are tied to a specific Server and are non-transferable between servers.
  • Contribution Points - internal system points awarded for community participation, project support, or free voting for the Application on third-party bot listing directories (e.g., Top.gg).
  • Paid Features (Premium) - optional digital enhancements (e.g., premium server status) unlocked via Discord's official in-app purchase system (Discord App Monetization) or through Contribution Points.

3. Terms of Use and Discord Platform Requirements

  1. User Age Requirement: By using the Application, the User represents and warrants that they meet the minimum age requirements of the Discord platform (at least 13 years of age, or the higher minimum age required by the applicable laws of the User's jurisdiction of residence).
  2. Compliance with Discord Terms: The User agrees to use the Application in full compliance with the Discord Terms of Service and the Discord Community Guidelines. Any use of the Application that violates Discord's platform policies is strictly prohibited.
  3. Management and Configuration Permissions: Any User adding the Application to a Server or modifying its settings represents and warrants that they hold the requisite permissions on that Server - specifically Administrator permissions, "Manage Server" (required, among other things, for configuring Community Badges), or "Manage Roles" (required, among other things, for managing Color Roles).

4. Acceptable Use Policy (Security Guidelines)

The Application is designed as a utility for community personalization, role management, and server achievements. The User agrees to use the Application responsibly and in compliance with all applicable laws. Specifically, the following actions are strictly prohibited:

  • Using the Application to publish, transmit, distribute, or facilitate access to unlawful, harassing, threatening, defamatory, hateful, malicious, or phishing content, or any material that infringes upon third-party rights.
  • Intentionally overloading the infrastructure, spamming commands, attempting to trigger database crashes or errors, or disrupting the continuous operation of the Application.
  • Attempting to circumvent rate limits, technical safeguards, or built-in cooldown periods, including limits imposed on data management commands.
  • Decompiling, reverse engineering, disassembling, copying, cloning, or creating unauthorized derivative works of the Application, except to the extent expressly permitted by mandatory provisions of applicable law.
  • Knowingly exploiting software bugs or vulnerabilities. Any discovered vulnerabilities or glitches must be promptly reported to the Creator via the official contact email or the Official Support Server.
  • Controlling or automating interactions with the Application using unauthorized scripts, self-bots, or automated data scraping tools.

In the event of a material or repeated violation of these rules, the Creator reserves the right to suspend or permanently ban the offending User or entire Server from accessing the Application (imposing a "blacklist").

If a User's breach of these Terms causes direct damage or loss to the Creator (including direct financial loss, excessive infrastructure hosting costs, or necessary legal defense fees), the Creator reserves the right to seek damages and compensation under general principles of applicable law.

5. Virtual Items, Badges, and Points

  1. Cosmetic and Digital Nature: All Color Roles, Community Badges, and Contribution Points are strictly digital and cosmetic within the Discord platform.
  2. No Monetary Value: Community Badges, Color Roles, and Contribution Points hold no property, market, or monetary value. They do not constitute financial instruments, virtual currencies, or legal property, and cannot be exchanged, redeemed, or refunded for fiat currency, cryptocurrency, or any tangible goods or services.
  3. Intellectual Property and Custom Emojis:
    • Users and Server managers do not acquire any ownership or proprietary copyright in the Application's core system architecture, badge mechanisms, or database schemas.
    • Community Badges rely on standard Discord Unicode symbols or server custom emojis uploaded directly to a Server by authorized individuals. The Application stores only technical identifiers and text references (such as Emoji IDs, names, and descriptions) and does not host graphic image files.
    • The respective Server administration assumes sole responsibility for emoji selection, naming, and descriptions used in Community Badges. The configuring party represents that all custom assets do not violate third-party intellectual property rights or Discord's Community Guidelines.
  4. Prohibition of Real Money Trading (RMT): Selling, trading, bartering, or transferring Community Badges, Color Roles, Contribution Points, or access to Application features for real currency, cryptocurrency, or external consideration (including Discord Nitro subscriptions) outside of official Discord platform mechanisms is strictly prohibited.
  5. Adjustments and Bug Rectification: In the event of technical malfunctions, abuse, or unauthorized duplication of points, the Creator reserves the right to adjust, recalibrate, or reset virtual items and balances to restore system integrity.
  6. Removal of the Application from a Server and Data Retention: Removing the Application from a Server immediately terminates access to its features on that Server. In such cases:
    • Community Badges - as a feature managed directly by the Application - immediately become inaccessible, uneditable, and cease to be displayed.
    • Color Roles - as roles existing directly within the Discord server hierarchy - remain on the Server and stay assigned to members (unless manually deleted by Server administrators), but can no longer be assigned, modified, or managed via the Application.
    • Associated Server configuration data is generally permanently deleted from the Application's database approximately 7 days after the Bot is removed. Re-inviting the Application within this period may allow restoring previous settings; however, data preservation or restoration is not guaranteed. No claims, refunds, or compensation shall arise from the removal of the Application or the resulting loss of configuration data.

6. Payments and In-App Purchases (Discord App Monetization)

  1. Merchant of Record: Optional digital upgrades and premium tiers are offered exclusively through Discord's official in-app purchase platform (Discord App Monetization). All transactions, payment processing, invoice generation, and tax remittances (including VAT/sales tax) are conducted and fulfilled directly by Discord Inc. as the independent Merchant of Record.
  2. Order Fulfillment: Access to purchased digital features or Contribution Points is granted automatically and without undue delay to the designated User account or Server upon receipt of transaction authorization confirmation from the Discord platform.
  3. Refunds: Because all payment transactions are handled exclusively by Discord Inc., all refund requests are subject to Discord's Paid Services Terms and must be submitted directly to Discord Customer Support. The Creator does not collect, process, or store credit card numbers or banking details and lacks the technical capability to issue financial refunds directly.
  4. Chargebacks and Disputes: In the event of an unauthorized chargeback, payment dispute, or fraudulent transaction, associated premium features or points will be immediately revoked, and the relevant User or Server may be permanently restricted from accessing the Application.

7. Third-Party Platforms and Infrastructure Dependencies

  1. Discord Platform Infrastructure: The functionality of the Application is inherently dependent on the continuous availability of the Discord platform and its API. The Creator assumes no liability for service interruptions, delayed role synchronization, missed notifications, or loss of connectivity caused by outages, degradation, or scheduled maintenance on Discord's side.
  2. External Directories (e.g., Top.gg): Third-party bot listing and voting directories operate on independent technical infrastructure. The Creator does not guarantee uninterrupted, immediate, or error-free delivery of incoming webhooks delivering vote confirmations and Contribution Points.
  3. Web and Edge Network Infrastructure (Cloudflare): Availability of the Application's official website and documentation relies on Cloudflare services (including Cloudflare Pages). The Creator is not responsible for temporary disruptions in website availability caused by global Content Delivery Network (CDN) or edge node failures.
  4. Hosting and VPS Providers: Core Application processes and databases depend on the infrastructure of third-party server providers (including Datalix VPS hosting located in Germany, European Union). The Creator is not liable for Bot downtime caused by hardware failures, power outages, or backbone routing incidents at the hosting provider's data centers.

8. Intellectual Property Rights

  1. Application Rights and Materials: All intellectual property rights in and to the Rinelle Application - including source code, database architecture, proprietary mechanics, names, logos, documentation, and official artwork - are owned by the Creator or used under valid licenses, commercial permissions, and legal rights.
  2. Character Design and Fictional Nature: The Application's official visual assets, including character designs (OCs), bot avatars, and logos, represent original stylistic concepts of the Creator. Any resemblance to existing fictional characters, third-party projects, trademarks, or general genre tropes is entirely coincidental and unintentional.
  3. Scope of Permitted Use: Using the Application, inviting it to a Server, or acquiring paid features does not transfer any proprietary copyrights or intellectual property rights to the User or Server administrators. The Creator grants the User a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to utilize the Application's features solely in accordance with its intended purpose and these Terms.
  4. Protection of Visual Assets: Copying, modifying, redistributing, reverse-engineering, decompiling the source code, or utilizing the Application's official graphics, avatars, or brand identity outside of the Discord platform without prior express written consent from the Creator is strictly prohibited.
  5. Notice and Takedown Procedure: The Creator respects the intellectual property rights of others. If an entity has a good-faith belief that any graphic element or content associated with the Application infringes upon their copyright, they are invited to notify the Creator via the official contact email or Official Support Server for prompt verification and corrective action (including the potential removal or modification of the disputed element).

9. Privacy and Data Protection

The Creator values User privacy and strictly adheres to data minimization principles:

  • Privacy Policy: Detailed rules regarding data collection, processing purposes, legal bases, and retention schedules are set forth in the Rinelle Privacy Policy.
  • Server Location: The primary database of the Application is hosted on secure servers located in Germany (European Union), ensuring data processing complies with EU GDPR (RODO) standards.
  • No Access to Message Content: The Application does not read, process, intercept, log, or record the content of direct messages (DMs), server text channel discussions, or voice communications.
  • User Autonomy and Self-Service: Users retain full control over their data and can execute built-in privacy commands at any time:
    • /privacy get-my-data - generates and delivers an export of all technical records associated with the User's account.
    • /privacy delete-my-data - permanently and immediately deletes all data associated with the User from the Application's database. The User acknowledges that this action is irreversible and permanently resets all account progression, Contribution Points, and digital perks.

10. Service Availability and Maintenance

  1. Uptime Target: The Creator endeavors to maintain stable and continuous Bot operations. Under normal operating conditions (excluding incidents outside the Creator's reasonable control, such as Discord outages, Cloudflare issues, or datacenter failures), the technological goal is to maintain a monthly availability rate of at least 98.0%. This target reflects a best-effort quality objective and does not constitute an absolute commercial warranty.
  2. Maintenance Windows: Due to ongoing software updates and Discord API modifications, the Creator reserves the right to implement technical maintenance windows necessary for code deployments, database optimization, or bug fixes. Scheduled maintenance will be announced in advance on the Official Support Server whenever feasible.
  3. Feature Modifications: Individual features, commands, or badge mechanics may be adjusted, updated, or retired as the project evolves, code is optimized, or Discord API changes require.
  4. Project Discontinuation: Should the decision be made to permanently decommission the Rinelle project, notice will be provided at least 30 days in advance on the Official Support Server and website to allow Server administrators to adjust their configurations.

11. Limitation of Liability and Disclaimers

  1. "As Is" and "As Available" Service: To the fullest extent permitted under applicable law, the Application is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of uninterrupted uptime, total error-free operation, merchantability, or fitness for a particular purpose.
  2. Scope of Exclusions: While the Creator exercises reasonable care to ensure stability, to the extent permitted by law, the Creator shall not be liable for:
    • Indirect, incidental, special, consequential, or punitive damages, loss of profits (lucrum cessans), loss of data, loss of goodwill, or non-material damage;
    • Disruptions, delays, or data loss caused by failures of third-party platforms (including Discord, Cloudflare, or hosting facilities);
    • Independent acts, omissions, or misconfigurations by Server administrators or moderators (including accidental deletion of roles, kicking the Application, or flawed configuration).
  3. Monetary Liability Cap: Where mandatory provisions of applicable law prohibit the complete exclusion of liability (excluding damages caused by intentional misconduct or gross negligence where prohibited), the Creator's total aggregate liability arising out of or related to the Service shall be limited to the amount actually paid by the User for the Application's services within the 12 months immediately preceding the claim, or in the case of free use, liability is excluded in full (amounting to 0.00 PLN / €0.00 / $0.00).

12. Consumer Rights in Poland and the European Union

  1. Consumer Protection: If the User accesses the Application as a Consumer (a natural person acting for purposes outside their trade, business, craft, or profession) residing in Poland or any other European Union member state, or as an individual entitled to statutory consumer protections under applicable law:
    • Nothing in these Terms excludes or limits any mandatory statutory consumer rights granted to the User under the Polish Civil Code, the Polish Consumer Rights Act, relevant EU Directives, or the mandatory consumer protection laws of the User's habitual residence, which cannot be waived or restricted by contractual agreement.
  2. Conflict of Terms: If any provision of these Terms - particularly regarding warranty disclaimers, liability caps, or complaint procedures - is found to conflict with mandatory consumer protection laws in the User's jurisdiction, such statutory laws shall supersede the conflicting provision, while all remaining provisions of these Terms shall remain in full force and effect.
  3. Alternative Dispute Resolution (ADR): A User acting as a Consumer may utilize out-of-court dispute resolution mechanisms available under applicable laws, including assistance from municipal or county consumer ombudsmen, proceedings conducted by authorized alternative dispute resolution entities, and, in the case of cross-border disputes within the European Union, the European Consumer Centres Network (ECC-Net). In Poland, the register of authorized ADR entities is maintained by the President of the Office of Competition and Consumer Protection (UOKiK). Information regarding available dispute resolution mechanisms and the directory of ADR entities across European Union member states is also accessible via the European Commission's Consumer Redress portal at: https://consumer-redress.ec.europa.eu/.
  4. Users in Australia (Australian Consumer Law): For Users subject to Australian law, nothing in these Terms excludes, restricts, or modifies any rights, remedies, or consumer guarantees available under Schedule 2 of the Competition and Consumer Act 2010 (Australian Consumer Law) that cannot be lawfully excluded or limited.

13. User Indemnification

The User agrees to defend, indemnify, and hold harmless the Creator from and against any reasonable and documented claims, liabilities, damages, losses, and expenses (including reasonable legal defense fees) asserted by third parties or Discord Inc. arising directly out of or resulting from:

  • The User's unlawful or unauthorized use of the Application in breach of these Terms;
  • The User's culpable infringement of any applicable laws, regulations, or third-party rights (including intellectual property and privacy rights);
  • Any severe violation of Discord's Terms of Service or Community Guidelines committed by the User through or in connection with the Application.

14. Changes to these Terms

  1. Grounds for Amendments: The Creator reserves the right to amend these Terms solely for valid technical, operational, or legal reasons, including:
    • Aligning the Terms with changes in statutory laws or Discord Developer Terms and Guidelines;
    • Introducing new features, optimizing database architecture, or upgrading Application performance;
    • Reflecting modifications in Discord's monetization infrastructure (Discord App Monetization) or external integrations;
    • Addressing critical security vulnerabilities or preventing system abuse.
  2. Notification and Notice Period:
    • For material modifications, Users will be notified at least 14 days in advance via an announcement posted on the Official Support Server and by updating the "Last updated" date at the top of these Terms.
    • Non-material amendments, minor clerical corrections, or immediate updates required for emergency security hotfixes or urgent Discord API policy changes take effect immediately upon publication.
  3. Consequences of Non-Acceptance:
    • If a User does not agree to the proposed revisions, they have the right to discontinue using the Application and remove it from their Servers prior to the effective date without incurring any penalties.
    • Continued use of the Application after the effective date of the amended Terms constitutes acknowledgment and acceptance of the updated Terms.

15. Governing Law, Jurisdiction, and Miscellaneous

  1. Governing and Prevailing Language: These Terms were originally drafted, executed, and published in the Polish language. Any translations into other languages (including this English version prepared for bot verification and accessibility purposes) are provided strictly for convenience and informational purposes. In the event of any discrepancy, ambiguity, or conflict of interpretation between translated versions and the Polish original, the Polish version shall exclusively govern and prevail.
  2. Governing Law: These Terms, the use of the Application, and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of laws principles, subject to any mandatory consumer protection regulations of the Consumer's country of habitual residence that cannot be derogated from by contract.
  3. Jurisdiction: Any legal disputes between the Creator and a non-consumer User shall be submitted to the exclusive jurisdiction of the competent Polish common court having territorial jurisdiction over the Creator's place of residence. For disputes involving Consumers, jurisdiction shall be determined by applicable statutory laws, including provisions granting Consumers the right to bring proceedings before courts in their place of residence.
  4. Severability Clause: If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction or authorized authority, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by valid Polish legal provisions closest to the intended economic and contractual purpose of the original term.
  5. Contact and Inquiries: All inquiries, bug reports, copyright takedown requests, or formal communications should be directed to the Creator via the Official Support Server on Discord or at: [email protected].
